Does a certificate of origin need an apostille or legalization?

Guide · 5 min read

A certificate of origin is a commercial document that states the country where goods were manufactured or produced. It is different from a notarial document or a civil record, which is why its authentication does not always follow the same path.certificado de origen es un documento comercial que declara el país donde se fabricaron o produjeron las mercancías. Es distinto de un documento notarial o de un acta civil, y por eso su autenticación no siempre sigue el mismo camino.

First: authenticating the document vs. certifying origin

It helps to separate two things. One is certifying the origin of the goods, which a chamber of commerce usually does. The other is authenticating the document so it is valid before a foreign authority — that is where the apostille or consular legalization comes in.certificar el origen de la mercancía, que normalmente hace una cámara de comercio. Otra es autenticar el documento para que tenga validez ante una autoridad extranjera, que es donde entran la apostilla o la legalización consular.

Which one applies to your case?

  • Many exports only require chamber-of-commerce certification, without an apostille.
  • If the destination country is in the Hague Convention and requires authentication, an apostille may be needed.
  • If the country is not in the Convention, consular legalization is usually required.
  • Sometimes the document must be notarized before it can be apostilled.

Before processing anything, confirm with your buyer or the importing country exactly what is required: chamber certification, apostille or legalization. We can help you determine the correct route.
