What is a Certificate of Free Sale?
A Certificate of Free Sale or export certificate attests to certain commercial or regulatory conditions of a product for its presentation in another country. Its name, content and issuing authority vary depending on the type of product and the requirements of the importing country.
Some countries or foreign authorities request a Certificate of Free Sale, a Certificate to Foreign Government or another export certificate to register or import food, supplements, cosmetics, medical devices, veterinary products and other regulated goods. The required documentation may vary by product and country; even a single country may accept different certificates depending on the category.
Depending on the destination country and the receiving authority, the certificate may require an apostille, additional authentication, consular legalization, translation, or no further authentication.
The issuing authority depends on the product
We review the issuing authority, the type of certificate and the available instructions from the receiving country to identify the applicable authentication procedure.
Food and supplements
The FDA may issue different certificates depending on the product category. The Certificate of Free Sale is used specifically for certain categories, such as dietary supplements, medical foods and foods for special dietary uses.
Medical devices
The FDA uses specific export certificates, such as the Certificate to Foreign Government, not necessarily a document called a Certificate of Free Sale.
Cosmetics
There may be federal, state or other export documents, depending on the product and the foreign requirement. Authentication must be verified with the receiving country.
Veterinary products and animal feed
The FDA also offers Certificates of Free Sale for certain categories of animal food and drugs.
State or other authorized issuers
Some certificates may be issued by state departments of health, agriculture or commerce, associations or authorized bodies.
